Manhattan Federal Judge Jeannette Vargas ruled that the Trump administration's January suspension of immigrant visas for citizens of 75 countries was unlawful. She argued that US Secretary of State Marco Rubio exceeded his authority and that the decision violated US immigration law.
The restrictions affected citizens of Brazil, Colombia, Uruguay, Bosnia and Herzegovina, Albania, Pakistan, and Bangladesh, as well as several countries in Africa, the Middle East, and the Caribbean. The State Department had previously stated that citizens of these countries allegedly had an increased risk of becoming dependent on US government resources. The court's ruling followed a lawsuit filed by human rights organizations, visa applicants, and American citizens sponsoring the relocation of relatives.
The ruling represents a significant legal setback for the Trump administration. The government can still appeal the decision and request a stay of its effects while the litigation continues.
